Terms of Service

These terms govern your use of Nudge (“the Service”), operated by Nudge (“we,” “us,” “our”). By creating an account or using the Service, you agree to these terms. If you are under 18, use Nudge only with a parent or guardian’s permission, and they should review these terms.
1. What Nudge is (and isn’t)
Nudge is a writing coach that asks questions about your college essay drafts. It does not write, rewrite, edit, or generate application writing for you. It does not guarantee admission to any school. It does not provide legal, educational, or admissions consulting advice.
Each college sets its own AI guidance. You are responsible for verifying your specific school’s current policy before submitting any application. Nudge is designed to ask questions, not generate application content, but we cannot guarantee compliance with every institution’s rules.
2. Your account
- You must provide accurate information when creating an account.
- You are responsible for keeping your login credentials secure.
- One account per person. Accounts are not transferable.
- You must be at least 13 years old to use Nudge.
3. Your content
As between you and Nudge, you retain the rights you have in the content you submit, including essays, context, notes, and references. You grant Nudge a limited right to host, store, transmit, process, and display that content as needed to operate and secure the Service, including sending relevant content to OpenAI’s API to provide AI features.
You are responsible for the content you enter. Do not use Nudge to process content you do not have the right to use, or content that is unlawful.
4. Paid plans and billing
Grandfathered Season Pass
This legacy plan remains available only to customers who purchased it before the monthly plan replaced it. Existing grandfathered customers retain access through the expiration date recorded for their account; there is no single expiration date that applies to every account. Refund availability is governed by the policy in effect at purchase.
Monthly subscription
New subscriptions are billed monthly through Stripe. You can cancel through the Stripe customer portal; access continues through the end of the current paid period. Refund requests are governed by the Refund Policy, including its 14-day window and rules about partial-month refunds.
Payments
Stripe-hosted Checkout processes payments and payment-method details. By purchasing, you agree to Stripe’s consumer terms. Prices and currency are shown at checkout. We may change pricing for future purchases; an existing subscription continues under its current billing terms until it is changed or canceled.
5. Fair use and usage limits
Paid access is subject to technical limits that help us protect capacity, prevent abuse, and keep the Service available. The current server-side limits include:

Other features may have additional technical limits, cooldowns, or availability requirements. We may change limits for security, capacity, product, or abuse-prevention reasons. If you have a legitimate use that is blocked, use our contact form.
We may throttle, suspend, or limit access if we detect automated, programmatic, or bulk usage that strains the Service or is inconsistent with personal essay coaching use. This includes using bots, scripts, or other automated means to interact with the Service.
6. Prohibited uses
You agree not to:
- Use Nudge on behalf of others in exchange for payment, including essay-writing services or admissions consulting businesses processing client essays through Nudge
- Attempt to extract, reverse-engineer, or replicate the AI prompts or question-generation system
- Resell, sublicense, or redistribute access to the Service
- Use automated tools such as bots, scrapers, or scripts to interact with the Service
- Interfere with the Service’s infrastructure or other users’ access
- Use the Service for purposes unrelated to personal college-application, scholarship, or related application-planning work
7. Intellectual property
The Nudge name, logo, question-generation system, prompts, and interface design are our intellectual property. You may not copy, modify, or distribute them. The questions Nudge generates for you are part of the Service — you may use them to improve your essays, but you may not republish, resell, or use them to build a competing product.
8. Disclaimers
Nudge is provided “as is.” We do our best to keep it running, accurate, and useful, but we do not guarantee:
- That every question will be relevant or helpful
- That the Service will be available 100% of the time
- That using Nudge will result in admission to any school
- That Nudge’s approach complies with every institution’s AI policy — check the current guidance for each college you use it for before submitting
9. Limitation of liability
To the maximum extent permitted by law, Nudge’s total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits rights or remedies that cannot be limited under applicable law.
10. Termination
You may request account closure or deletion through the contact form. We may suspend or terminate accounts that violate these terms, with notice when practical. After termination, retention and deletion of data follow our Privacy Policy; termination does not necessarily delete every provider or backup record immediately.
11. Changes to these terms
We may update these terms as the Service changes. We will update the effective date and, where required or appropriate, provide notice in the app or by email before a material change takes effect. Continued use after the effective date may constitute acceptance to the extent permitted by law.
12. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
